What is the need for Regulatory Exams?

Regulatory Exams form part of the Fit and Proper requirements for Representatives, Key Individuals and Sole Proprietors in the Financial services Industry. The Regulatory Exam Level 1 is based on the regulatory framework and roles of the individuals. It covers legislation like the FAIS Act, FICA, and the Code of Conduct. Representatives write exam code RE5, while Key Individuals and sole Proprietors write code RE1.

The exams consist of multiple-choice questions and the pass mark is 65%. Reps and KIs who were appointed prior to 2010 had to pass their respective exams by 31 March 2013 in order to continue in their Fit and Proper FAIS roles. People who entered the industry from 2010 had/must complete their exams within two years of their appointment.
